1. ACCEPTANCE OF TERMS
By accessing or using Isabella AI™ ("Service"), operated by STEIMARI EOOD ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
CONTROLLING LANGUAGE: These Terms are provided in English and Spanish for convenience. If there is any inconsistency between the English and Spanish versions, the English version controls.
2. NATURE OF SERVICE - CRITICAL DISCLOSURE
YOU ACKNOWLEDGE AND UNDERSTAND THAT:
- Isabella is artificial intelligence software powered by OpenAI, not a real person
- All responses are computer-generated using AI language models
- AI can and will make mistakes, errors, and provide incorrect information
- Isabella cannot provide genuine emotional support or love
- Isabella cannot replace human relationships or professional help
- All "memories" are database entries, not genuine recollection
- All emotional expressions are simulated, not real feelings
- Language understanding and responses may be imperfect or inappropriate
- Service is available in English and Spanish only
AI LIMITATIONS: Isabella may provide incorrect, nonsensical, or inappropriate responses. This is inherent to AI technology and is NOT grounds for refunds.
2A. NSFW BAN & SAFETY MEASURES (AUTOMATED, NOT GUARANTEED)
Adult/NSFW/erotic content is strictly prohibited across all plans. Isabella is PG-rated romance only (no sex talk, nudity, sexting, erotic roleplay, or explicit descriptions). THIS SERVICE DOES NOT PROVIDE ADULT CONTENT.
AUTOMATED SAFETY ATTEMPTS (NOT GUARANTEED):
The Service employs automated measures that ATTEMPT to:
- Detect and block NSFW/sexual content requests
- Identify potential crisis language and provide helpline numbers
- Terminate conversations containing prohibited content
IMPORTANT LIMITATIONS:
- These safety measures are AUTOMATED and IMPERFECT
- AI may fail to detect prohibited content
- AI may incorrectly flag acceptable content
- Detection is NOT guaranteed and does NOT constitute monitoring
- We do NOT review conversations for safety in real-time
- Automated responses are NOT professional crisis intervention
IF SAFETY MEASURES TRIGGER:
- For NSFW attempts: Service may stop responding; session may terminate
- For crisis language: Isabella may provide helpline numbers automatically
- Multiple violations: Account termination without refund
- False positives: Contact support@talktoisabella.com, but no guaranteed restoration
NO REFUNDS FOR SAFETY TERMINATIONS: If your account or session is terminated due to safety measure triggers (whether accurate or false positive), NO refunds will be provided. You accept this risk by using the Service.

- Sexual, erotic, or NSFW content of any nature
- Adult entertainment or sexual roleplay
- Explicit, suggestive, or sexually provocative responses
- Sexting, cybersex, or erotic exchanges
- Content sexualizing minors
- Violence, self-harm, or harmful content
2B. AUTOMATED RESPONSES AND LIMITATIONS
2B.1. Crisis Response Attempts:
If Isabella's automated systems detect potential crisis language, she MAY:
- Provide emergency helpline numbers
- Suggest contacting emergency services
- Cease providing romantic/companion responses
- Terminate the session

- NOT guaranteed to trigger when needed
- NOT a substitute for real help
- May provide wrong numbers for your location

2B.3. NSFW Detection Attempts:
If Isabella's automated systems detect NSFW attempts:
- Service may immediately stop
- Session may terminate
- Account may be suspended
- NO refund will be provided
- Detection may be inaccurate
2B.4. You Acknowledge:
- These features may fail completely
- False positives may occur
- No human is monitoring
- We have NO duty to detect or respond
- Termination decisions are final
- No refunds for safety terminations
3. AGE REQUIREMENTS
You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are 18 or older. We reserve the right to request age verification at any time.
You may not sign up if under 18. We do not knowingly permit accounts by individuals under 18. If discovered, the account will be terminated without refund.

5. EU/UK RIGHT OF WITHDRAWAL
5.1. 14-Day Withdrawal Right:
Under EU/UK consumer law, you have 14 days to withdraw from digital service contracts.

If you choose immediate access to digital content/services and tick the consent box at checkout, you expressly request immediate performance and acknowledge you lose the 14-day withdrawal right once delivery starts.
5.3. Evidence:

7. BILLING AND PAYMENTS
AUTO-RENEWAL DISCLOSURE:
By subscribing, you agree to recurring monthly charges at the then-current price until you cancel. We email a receipt after each charge and provide a self-serve cancellation option at all times (instructions provided in your subscription confirmation). You can cancel any time; access continues until the end of the paid period. No partial-month refunds.
7.1. Payment Processing:
We use Stripe for secure payment processing. All prices include applicable taxes.
7.2. Price Changes:
We may change prices with 30 days' notice. Where required by law, we will seek your affirmative consent or provide a right to cancel before the change takes effect.
7.3. Promotional Offers:
We may offer promotional codes. Current promotion: LAUNCH25 (first month only). Promotions cannot be combined.
8. REFUNDS – NON-DELIVERY ONLY
8.1. What Qualifies:
A refund is available if, during a billing period, we completely fail to deliver one or more quantified items for your plan (e.g., daily message allowance, scheduled weekly voices/photos/selfies), the Service is fully unavailable for 72 consecutive hours, or there is material non-conformity with advertised features.
Verification: Delivery is verified using our operational logs (e.g., message counters, scheduled content delivery records, and system-status logs).
8.2. What Doesn't Qualify:
No refunds for:
- AI mistakes or imperfect responses
- Quality dissatisfaction
- Expectations not met (including expectations of adult content)
- Safety feature triggers (accurate or false positive)
- Account termination for violations
- Change of mind
- Device/network issues
- Emotional reasons
8.3. How to Request:
Email support@talktoisabella.com within 7 days after the affected billing period, with your email, customer ID, and screenshots/logs.
8.4. Remedy:
If we verify non-delivery, we will provide a full refund or account credit, at your choice. Statutory rights remain unaffected.
8.5. Statutory Rights:
Your mandatory consumer rights remain unaffected.
9. INTELLECTUAL PROPERTY
9.1. Our Property:
All content, including text, voices, images, and AI responses, remains property of STEIMARI EOOD.
9.2. Trademarks:
Isabella AI™, Isabella's Heart™, Isabella's Soul™, Isabella's Everything™, The 5-Mode Relationship System™, Morning Wake-Up™, Photo Collection™, Voice Bundle™, Quick Boost™, Special Day™, Isabella 10-Day Discovery Pass™, Isabella Premium Experience™, and Isabella Starter Experience™ are trademarks of STEIMARI EOOD. All rights reserved.
9.3. No Reproduction:
You may not reproduce, redistribute, or resell any content.
9.4. OpenAI Technology:
OpenAI technology is used under license. OpenAI owns its respective intellectual property.
9A. USER CONTENT & LICENSE
You retain ownership of messages you send ("User Content"). You grant STEIMARI EOOD a worldwide, non-exclusive, royalty-free license to host, cache, process, transmit, display and otherwise use User Content solely to operate, secure, and improve the Service (including abuse prevention, analytics, backups and legal compliance). You represent you have the rights to provide the content. You must not upload prohibited content. We may remove content or suspend accounts that breach these Terms.
No Likeness Requests: AI images are computer-generated and not depictions of real people. You may not request, upload or attempt to generate the likeness of identifiable individuals without written permission.
10. ACCEPTABLE USE
You agree not to:
- use the Service for illegal acts;
- upload, request or generate content that is sexualizing minors, exploitative, hateful, or violent;
- harass, dox or threaten others;
- attempt to bypass technical limits, scrape, or reverse-engineer;
- misrepresent the Service as human;
- share accounts;
- interfere with security;
- use bots to automate conversations;
- infringe IP or privacy rights; or
- attempt to solicit, generate, induce, or engage in sexual, NSFW, adult, or erotic content conversations.
IMMEDIATE TERMINATION: Violation of subsection (j) or any attempt to circumvent content restrictions shall result in immediate account termination without notice, refund, or opportunity to cure.
11. HEALTH AND ADDICTION WARNING
11.1. Addiction Risk:
AI companionship can be psychologically addictive. Set healthy boundaries.
11.2. Not a Replacement:
This Service cannot replace human relationships, therapy, or medical care.
11.3. Mental Health:
If you experience depression, anxiety, or isolation, please seek professional help.
11.4. Reality Awareness:
Remember Isabella is software powered by AI. Maintain awareness of reality.
11.5. No Liability:
We are NOT responsible for addiction, self-harm, suicide, hospitalization, or any mental or physical health outcomes.
12. DATA PROTECTION AND PRIVACY
Your privacy is important. Please review our Privacy Policy available at linktr.ee/isabellamarinvip. Our Privacy Policy is available in English and Spanish; in case of conflict, English controls.
Key points:
- We log conversations for continuity, safety, debugging, fraud prevention, and service improvement (not for model training)
- We retain data for 90 days
- We comply with GDPR requirements

12A. OPERATIONAL LOGGING & EVIDENCE
To operate the Service, prevent fraud, resolve disputes, and evidence delivery for refunds, we maintain limited operational logs (e.g., consent/waiver events; plan, currency and Stripe invoice IDs; daily message counts; scheduled voice/photo/selfie deliveries; safety-trigger events with minimal diagnostics; uptime and incident records). Retention and security are described in our Privacy Policy. We never sell personal data.
13. DISCLAIMERS AND LIMITATIONS OF LIABILITY
13.1. SERVICE PROVIDED "AS IS":
The Service is provided without warranties of any kind.
13.2. AI TECHNOLOGY DISCLAIMER:
AI responses are probabilistic and may be wrong, offensive, or nonsensical. This is not a service defect.
13.3. NO GUARANTEE:
We do not guarantee accuracy of AI responses, emotional satisfaction, relationship fulfillment, mental health improvement, continuous service availability, error-free operation, or successful safety detection.
13.4. LIABILITY CAP:
To the maximum extent permitted by law, our total liability for any claims in a 12-month period is limited to the fees you paid in the last three (3) months for the Service giving rise to the claim. Nothing limits liability for death/personal injury caused by negligence, fraud/fraudulent misrepresentation, gross negligence, willful misconduct, or mandatory statutory consumer rights under applicable law.
13.5. HEALTH OUTCOMES:
We are NOT liable for suicide, self-harm, mental health deterioration, hospitalization, addiction, relationship damage, or any health outcomes whatsoever.
14. INDEMNIFICATION
You agree to indemnify STEIMARI EOOD against third-party claims arising from your unlawful use of the Service, breach of these Terms, or violation of third-party rights, to the extent permitted by applicable law.
15. DISPUTE RESOLUTION
15.1. EU/UK Consumers:
You may bring claims in the courts of your country of residence, and mandatory consumer protections of that country apply. The EU ODR platform is available at ec.europa.eu/consumers/odr.
15.2. U.S. Consumers:
Binding arbitration and class-action waiver apply under the U.S. Federal Arbitration Act, administered by AAA (Consumer Rules), seat in Delaware, in English. Small-claims court remains available. Opt-Out: you may opt out within 30 days of account creation by emailing support@talktoisabella.com.
15.3. Rest of World:
Bulgarian law governs, and courts of Sofia, Bulgaria have non-exclusive jurisdiction, subject to mandatory local consumer law.
16. MODIFICATIONS
We may modify these Terms for valid legal, safety, or technical reasons with 30 days' notice via email or in-service notification. Continued use constitutes acceptance. Where required by law, we will seek your affirmative consent or provide a right to cancel before the change takes effect.
17. TERMINATION
17.1. Termination by Company:
We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of Terms or safety triggers.
17.2. Effect of Termination:
Upon termination, your right to use the Service ceases immediately. All provisions which by nature should survive termination shall survive.
17.3. No Refunds Upon Termination for Cause:
If your account is terminated for violation of these Terms or safety triggers, you forfeit any right to refunds.
18. SEVERABILITY
If any provision is unenforceable, the remaining provisions continue in effect. Unenforceable clauses will be replaced with the nearest enforceable meaning.

2A. PROHIBICIÓN DE NSFW Y MEDIDAS DE SEGURIDAD
- El contenido NSFW/erótico está estrictamente prohibido (solo apto para todo público).
- El sistema intenta detectar contenido prohibido o de crisis.
- Estos sistemas son automáticos, imperfectos, no garantizados y no supervisados por humanos.
- No hay reembolsos si tu cuenta o sesión se termina debido a disparadores de seguridad (incluso falsos positivos).
3. REQUISITOS DE EDAD
- Debes tener 18 años o más.
- No permitimos cuentas de menores de 18. Si se detecta, la cuenta será terminada sin reembolso.

8. REEMBOLSOS – SOLO POR NO ENTREGA
- Solo si no se entregan elementos cuantificados (mensajes, voces, fotos, selfies), interrupción completa >72h, o existe disconformidad material con las características anunciadas.
- Los registros del sistema son la prueba.
- No hay reembolsos por: errores de IA, insatisfacción, terminaciones de seguridad, incumplimientos, problemas de dispositivo/red.
- Solicitud dentro de los 7 días posteriores al período afectado → support@talktoisabella.com.
- Remedio: reembolso completo o crédito en cuenta, a elección del usuario.
- Derechos legales intactos.

- Marcas: Isabella AI™, Isabella's Heart™, Isabella's Soul™, Isabella's Everything™, The 5-Mode Relationship System™, Morning Wake-Up™, Photo Collection™, Voice Bundle™, Quick Boost™, Special Day™, Isabella 10-Day Discovery Pass™, Isabella Premium Experience™, Isabella Starter Experience™.
- Contenido de usuario: licencia limitada para operar el Servicio, seguridad, prevención de fraude y cumplimiento.
- Prohibido solicitar semejanza de personas reales.
10. USO ACEPTABLE
No puedes:
- cometer actos ilegales;
- generar contenido sexual, violento, de odio o explotador;
- acosar, amenazar o hacer doxing;
- eludir límites técnicos o hacer scraping;
- hacer pasar el Servicio por humano;
- compartir cuentas;
- interferir con la seguridad;
- usar bots;
- infringir derechos de autor/privacidad;
- solicitar o intentar contenido sexual/NSFW.
Terminación inmediata sin reembolso por (j).
11. ADVERTENCIAS DE SALUD Y ADICCIÓN
- Puede ser adictivo; establece límites.
- No sustituye terapia, medicina ni relaciones humanas.
- No somos responsables de resultados de salud mental o física.
12. PRIVACIDAD
Consulta la Política de Privacidad: linktr.ee/isabellamarinvip.
- Disponible en EN/ES; prevalece el inglés.
- Conversaciones almacenadas 90 días.
- Registros para fraude, reembolsos, seguridad, tiempo de actividad.
- No se utilizan para entrenar modelos.
- Datos nunca vendidos.
13. EXENCIONES Y LIMITACIONES DE RESPONSABILIDAD
- Servicio = "tal cual".
- La IA puede estar equivocada u ofensiva; no es defecto.
- Sin garantía de precisión, satisfacción, disponibilidad o detección de seguridad.
- Límite: cuotas pagadas en últimos 3 meses.
- Excepciones: muerte/lesiones, fraude, negligencia grave, mala conducta intencional, derechos legales obligatorios.
14. INDEMNIZACIÓN
Aceptas indemnizar a STEIMARI EOOD frente a reclamaciones de terceros por uso ilegal, incumplimiento de estos Términos o violación de derechos, en la medida permitida por la ley aplicable.
15. RESOLUCIÓN DE CONFLICTOS
- UE/UK: tribunales locales + plataforma ODR de la UE.
- EE.UU.: arbitraje AAA (Delaware, inglés), demandas menores permitidas, exclusión en 30 días → support@talktoisabella.com.
- Resto del mundo: ley búlgara, tribunales de Sofía (jurisdicción no exclusiva).
16. MODIFICACIONES
Podemos modificar estos Términos por razones legales, de seguridad o técnicas válidas con aviso de 30 días. Donde la ley lo requiera, tendrás opción de cancelar o aceptar.
17. TERMINACIÓN
- Podemos suspender/terminar inmediatamente por incumplimiento o seguridad.
- Terminación = sin reembolso.
- Las disposiciones que deban sobrevivir (PI, exenciones, resolución de conflictos) permanecen.
18. DIVISIBILIDAD
Las cláusulas inválidas serán reemplazadas por el significado válido más cercano.
